By downloading, installing, or using QuestGains, you agree to these Terms. If you do not agree, do not use the app.
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User" or "you") and QuestGains ("Company," "we," "our," or "us") governing your use of the QuestGains mobile application and related services (collectively, the "Service").
These Terms incorporate Apple's Licensed Application End User License Agreement, available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, which applies when you download QuestGains from the App Store.
Subject to your compliance with these Terms, QuestGains grants you a limited, non-exclusive, non-transferable, revocable license to download and use the app for your personal, non-commercial purposes.

Subscription Plans
QuestGains Pro is available as an auto-renewing subscription through Apple In-App Purchase:
Free Trial
Where offered, a free trial period may be available. Payment will be charged to your Apple ID account at the end of the trial period unless cancelled at least 24 hours before the trial ends.
Auto-Renewal
Subscriptions automatically renew at the end of each subscription period unless cancelled at least 24 hours before the renewal date. Your Apple ID will be charged within 24 hours prior to the end of the current period at the applicable subscription rate.
Cancellation
You may cancel your subscription at any time by going to iOS Settings → [Your Name] → Subscriptions → QuestGains → Cancel Subscription. Cancellation takes effect at the end of the current paid period. No refunds are provided for unused portions of a subscription period, except as required by applicable law.
Price Changes
We may change subscription prices with advance notice. Continued use of the Service after a price change constitutes your agreement to the new price.
You must create an account to access QuestGains features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.
You must be at least 13 years of age to create an account. By registering, you represent that you are 13 or older.
You retain ownership of the fitness data and other content you submit to QuestGains. By submitting content, you grant QuestGains a limited license to store, display, and process that content solely for the purpose of providing the Service to you.
You are solely responsible for the accuracy of your fitness data. QuestGains does not verify user-submitted data and is not responsible for errors in your records.
QuestGains is a fitness tracking and gamification app. The app does not provide medical advice, diagnosis, or treatment. Content in the app is for informational and entertainment purposes only.
Consult a qualified healthcare provider before beginning any exercise program, particularly if you have a medical condition, injury, or health concern. You exercise at your own risk. QuestGains is not responsible for any injury or health outcome resulting from use of the app.
The QuestGains name, logo, app design, graphics, user interface, and all content created by QuestGains are the exclusive intellectual property of QuestGains and are protected by copyright, trademark, and other applicable laws.
Nothing in these Terms grants you any rights to use our trademarks, logos, or branding without our prior written consent.
You agree not to:
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
You may delete your account at any time through the app settings. Upon termination, your license to use the Service ends immediately.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, QUESTGAINS DISCLAIMS ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, QUESTGAINS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.
IN NO EVENT SHALL QUESTGAINS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU PAID TO QUESTGAINS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
When you download QuestGains from the Apple App Store, the following additional terms apply:
These Terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.
We may update these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where required, providing in-app notice. Your continued use of the Service after changes constitutes your acceptance of the revised Terms.
